General Terms and Conditions of BioDegradeGoods

Article 1 - Definitions

1. Entrepreneur: BioDegradeGoods, a sole proprietorship, established in Capelle aan den IJssel, registered with the Chamber of Commerce under number 87305798 , hereinafter referred to as "BioDegradeGoods".
2. Consumer: the natural person who does not act in the exercise of a profession or business and who enters into an agreement with BioDegradeGoods.
3. Agreement: the agreement between BioDegradeGoods and the consumer regarding the sale and delivery of products.
4. Products: the goods offered by BioDegradeGoods via the BioDegradeGoods.nl website.
5. Website: the BioDegradeGoods website, accessible via the internet address BioDegradeGoods.nl.

Article 2 - Applicability

1. These general terms and conditions apply to all offers, orders and agreements between BioDegradeGoods and the consumer, unless otherwise agreed in writing.
2. Deviations from these general terms and conditions are only valid if they have been expressly agreed in writing between BioDegradeGoods and the consumer.

Article 3 - Offers and orders

1. All BioDegradeGoods offers are without obligation and valid while supplies last.
2. The agreement is concluded when the consumer places an order via the BioDegradeGoods.nl website and BioDegradeGoods confirms this order by e-mail.

Article 4 - Prices and payment

1. The prices stated for the products are in euros and include VAT, unless stated otherwise.
2. Payment must be made in the manner indicated during the ordering process.
3. In the event of late payment, the consumer is legally in default and owes interest equal to the statutory interest.

Article 5 - Delivery and shipping

1. BioDegradeGoods will ship the products as soon as possible after receipt of the order, unless otherwise agreed.
2. The delivery period is indicative and not a strict deadline. Exceeding the delivery period does not entitle the consumer to compensation or termination of the agreement.
3. Shipping takes place at the risk of the consumer. BioDegradeGoods is not liable for loss, theft or damage during transport.

Article 6 - Right of withdrawal

1. The consumer has the right to terminate the agreement within fourteen days of receipt of the products without giving reasons.
2. To exercise the right of withdrawal, the consumer must inform BioDegradeGoods in writing within the stated period.
3. During the cooling-off period, the consumer will handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine the nature, characteristics and operation of the product.

Article 7 - Warranty

1. BioDegradeGoods guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and usability and the legal provisions and/or government regulations in force on the date of the conclusion of the agreement.
2. The warranty is limited to defects that arise during normal use within the warranty period.

Article 8 - Liability

1. BioDegradeGoods is not liable for damage of any nature whatsoever caused by BioDegradeGoods relying on incorrect and/or incomplete information provided by or on behalf of the consumer.
2. BioDegradeGoods is not liable for any indirect damage, including consequential damage, lost profits, missed savings and damage due to business stagnation.
3. BioDegradeGoods' liability is in any case limited to the amount of the payment made by BioDegradeGoods' insurer, insofar as this liability is covered by the insurance.

Article 9 - Intellectual property rights

1. All intellectual property rights relating to the products, the website and all content published thereon, including but not limited to texts, images, videos, logos and designs, belong to BioDegradeGoods or its licensors.
2. The consumer is not permitted to copy, distribute, reproduce or use any material from the website for commercial purposes without prior written permission from BioDegradeGoods.

Article 10 - Force majeure

1. In the event of force majeure, BioDegradeGoods is not obliged to fulfill its obligations towards the consumer, or the obligation will be suspended for the duration of the force majeure.
2. Force majeure means any circumstance beyond its control that prevents the fulfillment of its obligations towards the consumer in whole or in part. These circumstances include strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the website at any time.

Article 11 - Privacy

1. BioDegradeGoods respects the privacy of its customers and ensures that personal information is treated confidentially.
2. Personal data is processed in accordance with applicable privacy laws and regulations, including the General Data Protection Regulation (GDPR).
3. The consumer has the right at any time to inspect his or her personal data, to correct it or have it deleted.

Article 12 - Final provisions

1. If a provision of these general terms and conditions is void or voidable, this will not affect the validity of the other provisions. In that case, the parties will enter into proper consultation in order to agree on a replacement provision that is as close as possible to the purpose and scope of the void or annulled provision.
2. These general terms and conditions can be consulted on the BioDegradeGoods website and will be sent free of charge upon request.
3. These general terms and conditions are effective from [date] and replace all previous versions.
